Court of Protection Solicitor – Health & Welfare
Are you an experienced Court of Protection Solicitor with a strong interest in health and welfare law? A fantastic opportunity has become available to join a highly regarded, nationally recognised Court of Protection team, recently named a "Firm to Watch" by The Legal 500 . This role offers the chance to work alongside nationally appointed specialists and further develop your expertise in one of the most complex and rewarding areas of mental capacity law.
The growing Court of Protection team includes a Panel Deputy and an Accredited Legal Representative and is widely respected for its dedication to safeguarding the rights of vulnerable individuals. Due to continued expansion and an increasing workload, the team is now looking to recruit a committed and experienced Solicitor to manage a varied caseload of health and welfare matters under the Mental Capacity Act 2005.
This role would suit someone looking to take the next step in their career, as well as a senior practitioner seeking the opportunity to take on a leadership position, with genuine scope to manage the team for the right candidate.
Key Responsibilities:
*Manage a caseload of health and welfare Court of Protection matters, including s.21A and s.16 applications
*Meet clients, take instructions, prepare cases and undertake detailed legal research
*Draft applications, statements and other court documents and undertake advocacy where appropriate
*Ensure compliance with file management, regulatory and procedural requirements
*Support the Head of Department and contribute to strategic planning and service development
*Build and maintain professional relationships and contribute to business development initiatives
*Work sensitively and empathetically with vulnerable clients and their families
*Maintain accurate time recording and billing
*Implement feedback from file reviews to ensure continued improvement
Requirements:
*Qualified Solicitor in England & Wales with a current practising certificate
*Demonstrable experience handling Court of Protection health and welfare matters
*Strong knowledge of the Mental Capacity Act 2005 and relevant case law
*Experience with public and/or privately funded work
*Advocacy experience desirable but not essential
*Excellent written and verbal communication skills
*Ability to manage a complex caseload with minimal supervision
*Strong organisational, analytical and time management skills
*Professional, empathetic approach when working with vulnerable individuals
*Interest in business development and marketing is advantageous
